   TRANSFER OF VEHICLE OWNERSHIP IN ONTARIO

If you selling or purchasing a vehicle in Ontario, you may be required to submit various documents to Service Ontario or the Ministry of Transportation for legal transfers of ownership of a vehicle from one person to another. There are a several reasons to transfer car ownership in Ontario. The most common include gifting a vehicle to a family member, private sale to another individual, private purchase of a vehicle through a private sale.

Bill of Sale 

A bill of sale is a legal document that contains all the details of sale between the buyer and the seller. The document paves the way for new ownership and would generally include the following information relative to the vehicle being sold:
 

  • The name of both the buyer and the seller

  • The date and place where the sale was consummated

  • Vehicle description and identification number (VIN)

  • Any specific warranty that may have been agreed upon

  • The agreed sale price of the vehicle

Without the bill of sale and a signature from the seller, a new owner can't legally claim rights to the vehicle.

Affidavit of Vehicle Ownership without Bill of Sale

If you purchased a vehicle in Ontario but did not receive a bill of sale, vehicle ownership or it if was lost or destroyed, you will need to provide a notarized affidavit of ownership with details of purchase and reasons for not providing a bill of sale for registering your vehicle with Service of Ontario. If you do not have the seller's information, you can order a Used Vehicle Information Package from Service Ontario website: Used vehicle information package | ontario.ca. Sworn Statement for the Transfer of a Used Motor Vehicle in the Province of Ontario

You can transfer ownership of a vehicle to a family member without requiring them to pay the retail sales tax (RST) by completing Sworn Statement for the Transfer of a Used Motor Vehicle in the Province of Ontario.

Eligible family member include:

  • spouse (including a common law spouse)

  • parent or step-parent

  • grandparent or step-grandparent

  • son or step-son

  • daughter or step-daughter

  • grandson or step-grandson

  • granddaughter or step-granddaughter

  • son-in-law

  • daughter-in-law

  • father-in-law

  • mother-in-law

  • sibling

  • half siblings (siblings with a common parent)

  • adopted siblings (siblings with a common parent through adoption)

Registering a vehicle in the name of a business or a corporation

The (RIN) Letter/ Declaration is notarized document submitted to The Ministry of Transportation / Service Ontario in order to register a vehicle in the name of a business or a corporation. RIN is a 9 digit number used to identify the business (sole proprietorship, partnership) or a corporation within Ontario's motor vehicle registration system allowing you to obtain a permit and a license plate. Only corporate and business vehicles need a RIN. Once it is obtained, a single RIN can be re-used to register multiple vehicles belonging to a business or corporation.
